Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Panthalas website at panthalaa and your engagement with any Panthalas programme. By accessing the website or confirming a programme arrangement, you agree to these Terms. If you do not agree, please do not use our website or services. Panthalas is a financial education practice operating from George Town, Penang, Malaysia.
1. Definitions
- "Service" means the financial education programmes offered by Panthalas, including the Small Saving Pool Programme, the Reading Monthly Statements Programme, and the Household Shelf Engagement.
- "Participant" or "You" means the individual who engages Panthalas for a programme.
- "We / Us / Our" means Panthalas.
- "Session" means an individual meeting, held in person or over video, forming part of a programme.
- "Agreement" means the written programme confirmation exchanged between Panthalas and the Participant before work begins.
2. Acceptance of Terms
By submitting an enquiry form, confirming a programme arrangement in writing, or attending a session, you agree to be bound by these Terms. You must be at least 18 years of age to engage our services. If you are acting on behalf of a household, you confirm that you have authority to enter this agreement on behalf of all household members involved.
3. Service Description
Panthalas provides one-to-one financial education sessions for adults. The service is educational in character and does not include financial planning, investment advice, insurance advice, or the recommendation of any financial product. Sessions are delivered at the Panthalas studio in George Town, Penang, or over video. Full programme descriptions and prices are published on the Panthalas website.
4. Programme Arrangements
Each programme engagement is confirmed in a written summary sent to the Participant before the first session. This summary confirms the programme selected, the number of sessions, the fee, the payment schedule (if applicable), and the expected delivery format. The engagement begins when both parties have confirmed the arrangement in writing. Verbal commitments are not binding without a written summary.
5. Participant Responsibilities
- Attend sessions at the agreed time or provide at least 48 hours' notice if rescheduling is required.
- Bring or share the documents relevant to the session as agreed in advance.
- Use the materials and information provided by Panthalas for personal use only.
- Not share session content, printed materials, or proprietary Panthalas methods with third parties for commercial purposes.
- Engage with the programme in good faith.
6. Prohibited Activities
- Recording sessions (audio or video) without prior written consent from Panthalas.
- Reproducing or distributing Panthalas printed materials, worksheets, or review sheets commercially.
- Using sessions to obtain advice that constitutes regulated financial advice under Malaysian law.
- Misrepresenting your identity or financial situation in a way that materially affects the programme.
7. Intellectual Property
All programme materials, worksheets, printed guides, and methodology developed by Panthalas remain the intellectual property of Panthalas. Participants receive a non-exclusive, personal licence to use printed materials produced as part of their programme for their own use. This licence does not extend to reproduction, distribution, or commercial use.
8. Fees and Payment
Fees are as published on the Panthalas website and confirmed in the written programme agreement. Payment is by bank transfer. For the Household Shelf Engagement, a phased payment arrangement is available on request and confirmed in writing before the programme begins. Fees are due in accordance with the agreed schedule. Panthalas reserves the right to pause or conclude a programme if fees remain unpaid beyond the agreed date.
9. Cancellation and Rescheduling
- By the Participant: Sessions cancelled with less than 48 hours' notice may be forfeited without refund. Sessions cancelled with more than 48 hours' notice will be rescheduled at no additional cost.
- By Panthalas: In the event of illness or unavoidable circumstances, Panthalas will reschedule any session at no cost to the Participant.
- Programme withdrawal: If a Participant wishes to discontinue a programme after it has begun, fees for sessions already delivered are non-refundable. Fees for sessions not yet delivered will be refunded within 14 days of written notification.
10. No Financial Advice
Panthalas is a financial education service. Nothing communicated by Panthalas — in sessions, in written materials, or via the website — constitutes financial planning advice, investment advice, insurance advice, or any form of regulated financial advice under Malaysian law. Participants seeking regulated financial advice should consult a licensed financial adviser.
11. Disclaimer
The service is provided on an "as is" basis for educational purposes. Panthalas makes no representation that participation in any programme will produce specific financial outcomes, changes in behaviour, or improvements in a Participant's financial position. Individual outcomes depend on many factors outside Panthalas's control.
12. Limitation of Liability
To the extent permitted by law, Panthalas's liability for any claim arising from the delivery of a programme is limited to the fee paid for that programme. Panthalas is not liable for indirect, consequential, or financial losses arising from a Participant's use or reliance on any information or materials provided during a programme.
13. Indemnification
You agree to indemnify Panthalas against any loss, claim, or expense arising from your breach of these Terms, your misuse of programme materials, or any false or misleading information provided to Panthalas during a programme.
14. Termination
Either party may terminate a programme arrangement by written notice. If Panthalas terminates a programme arrangement due to a Participant's breach of these Terms, fees for sessions already delivered are non-refundable. If a Participant terminates, clause 9 applies. Clauses 7, 10, 11, 12, and 13 survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute will first be addressed through informal written communication between the parties, with a resolution period of 30 days. If unresolved, disputes will be submitted to the courts of Penang, Malaysia, which shall have exclusive jurisdiction.
16. General Provisions
- Entire agreement: These Terms, together with the written programme agreement, constitute the entire agreement between you and Panthalas for the relevant programme.
- Severability: If any clause is found unenforceable, the remaining clauses continue in full effect.
- Waiver: Failure to enforce any clause does not constitute a waiver of that clause.
- Assignment: You may not assign your programme arrangement to another person without written consent from Panthalas.
17. Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page will reflect the most recent revision. For active programme participants, material changes will be communicated by email at least 14 days before they take effect.
